SAMHSA has published its long awaited Mandatory Guidelines for Federal Workplace Drug Testing Programs Oral/Fluid  authorizing oral fluid laboratory based testing for federal workplace drug testing programs.             Please note that the SAMHSA Rule does not authorize oral fluids laboratory-based testing for United States Department of Transportation Agency(s) mandated testing at this time because:

  1. Additional rulemaking by the U.S. Department of Transportation updating 49 CFR Part 40 and the DOT Agencies is required.
  2. The testing laboratories must obtain certification from SAMHSA prior to conducting oral fluids laboratory testing.
  3. Revisions to the federal custody and control form (also used for DOT mandated testing) must be obtained by the SAMHSA certified testing laboratories.
