At First Advantage, we are committed to protecting your personal data and act as Data Processors in accordance with Law 1581 of 2012 and other applicable regulations in Colombia.

First Advantage offers background screening services to help companies make more informed decisions about candidates, employees, and third parties. Our goal is to reduce risks, mitigate fraud, and promote safer work environments, always prioritizing privacy and information protection.

In this context, your personal data will be processed in accordance with the principles of legality, purpose, freedom, accuracy, transparency, restricted access and circulation, security, and confidentiality.

For greater clarity, the following section explains some key concepts.

Important definitions

In accordance with Colombian law, the following definitions apply:

Privacy Notice:  Physical, electronic, or any other format document made available to the Data Subject to inform them about the processing of their personal data.

Authorization: Prior, express, and informed consent given by the Data Subject for the processing of their personal data.

Personal Data: Any information linked or that can be associated with a specific or identifiable natural person.

Sensitive Data: Data that affects the privacy of the Data Subject or whose misuse may lead to discrimination, such as data on criminal records or health information.

Data Processor: Natural or legal person who processes personal data on behalf of the Data Controller.

Data Controller: Natural or legal person who decides on the basis of the database and/or the processing of personal data.

Data Subject: Natural person whose personal data is being processed.

Processing: Any operation on personal data, such as collection, storage, use, circulation, or deletion.

Transfer: Sending personal data to a third party within or outside the country.

How do we collect your personal data?

We may obtain your information in different ways, depending on the type of service:

Information you provide directly to us
When you interact with our services, for example, when applying for a job with one of our clients or directly with First Advantage.

Through our clients
When we conduct periodic checks on their employees or subcontracted personnel.

From public sources
Such as social media or online search engines, when permitted by law.

From authorized sources
Such as government authorities, courts, public records, educational institutions, or current and former employers.

Additionally, we may collect information by monitoring the use of our website, for example, through cookies and similar technologies such as web beacons.

We also obtain personal data when you complete online forms or communicate with us through our chat.

Purpose of personal data processing

Personal data and/or sensitive data provided through the sources described are used to:

  • confirm identity
  • validate background information
  • verify employment references
  • verify academic references
  • consult public or private records
  • comply with legal obligations
  • prevent fraud

Further processing will be carried out for the period necessary to fulfill the purpose and applicable legal obligations.

Use for marketing purposes

We do not use personally identifiable information for marketing or advertising purposes unless we have your explicit consent, for example, when you fill out a form or use our chat for that purpose.

When data is used for statistical purposes, it will be anonymized beforehand.

What data can we process?

Depending on the service, we may process categories such as:

  • identification data
  • contact details
  • employment data
  • academic data
  • home address information
  • financial data when required by the service
  • sensitive data when strictly necessary

In cases involving sensitive data, its provision is optional.

The Data Subject is not obliged to authorize its processing. When necessary, prior, express, and informed authorization will be requested in accordance with the law.

Processing of Sensitive Data

First Advantage may process sensitive data only when strictly necessary to:

  • comply with the requesting client’s legal or regulatory obligations;
  • verify the suitability of the data subject for a specific position, where permitted by law.

This data will be processed under enhanced security measures and never for discriminatory purposes.

Transfer of personal data

First Advantage may transfer your personal data when:

  • it is necessary to perform the requested verification;
  • there is a legal requirement;
  • it is ordered by a competent authority.

In these cases, contractual and technical measures will be taken to ensure your protection.

Disclosure of personal information

We do not disclose your personal information to third parties outside of the cases provided for in this Privacy Policy, except when permitted by law or authorized by you.

In all cases, the third party receiving the information must comply, by law or contract, with security and confidentiality obligations. Likewise, they may only use the data for the purposes described in this Policy.

Retention of personal data

We will retain your personal data only for as long as necessary to fulfill the purposes of the service and in accordance with the requirements established by our client, who acts as the Data Controller.

Additionally, there may be legal provisions or requirements from authorities that oblige us to retain the information for a specific period.

When there is no defined period, we will delete personal data within a maximum of two years after the verification process has been completed.

Rights of personal data subjects

You may exercise the following rights at any time:

  • access, update, and rectify your personal data;
  • request proof of the authorization granted;
  • be informed about the use of your data;
  • file complaints with the Superintendency of Industry and Commerce;
  • revoke the authorization or request the deletion of the data when appropriate.

The request must include:

  • full name;
  • identity document;
  • clear description of the request;
  • contact details for a response.

It is important to note that, in some cases, we will not be able to comply with your request or suspend use immediately, for example, when there is a legal obligation that requires us to continue processing the data..

Similarly, revoking consent for certain purposes may mean that it is not possible to continue with the applicable legal relationship.

First Advantage will respond to your request within a maximum of 20 business days, in accordance with current Colombian regulations. The exercise of these rights will also be carried out in accordance with the applicable laws and regulations in the country.

Means to limit the scope (use or disclosure) of your personal data

You or your duly accredited legal representative may, at any time, request the limitation of the use or disclosure of your data when it is not necessary for the purpose that gave rise to the processing.

Changes to the privacy policy
