Processor of Personal Data

At First Advantage, we are committed to protecting your personal data and act as Processor of its processing in accordance with the Mexican Federal Law on Protection of Personal Data Held by Private Parties (LFPDPPP).

First Advantage provides background screening services to help organizations make informed decisions regarding customers, partners, candidates, employees and third parties. Our objective is to reduce fraud, mitigate risks and contribute to a safer society while prioritizing privacy and information protection.

Your personal data will be processed in accordance with the principles of lawfulness, fairness, transparency, consent, purpose limitation, proportionality, quality, accountability, security and confidentiality, and only for the purposes described in this Privacy Notice and under applicable law.

For clarity, the following section explains key concepts used in this document.

Key Definitions

In accordance with the LFPDPPP, the following definitions apply:

Privacy Notice: This document made available to the Data Subject in physical, electronic or any other format.

Consent: The express or implied authorization granted by the Data Subject for the processing and transfer of personal data under this Privacy Notice.

Personal Data: Information relating to an identified or identifiable natural person.

Sensitive Personal Data: Data revealing racial or ethnic origin, health status, genetic information, religious, philosophical or moral beliefs, union membership, political opinions or sexual preference, which may result in discrimination or serious risk to the Data Subject.

Processor: The individual or legal entity processing personal data on behalf of the Controller.

Controller: The individual or legal entity deciding on the processing of personal data.

Third Party: Any individual or entity other than the Data Subject, Controller or Processor.

Data Subject: The individual to whom the personal data relates.

Processing: Collection, use, disclosure, storage or any action involving access, handling, transfer or disposal of personal data.

Transfer: Any communication of personal data to a third party other than the Controller or Processor.

How We Collect Personal Data

We may obtain your information through different sources depending on the service:

Information provided directly by you

When interacting with our services, including applying for a job with our clients or with First Advantage.

Through our clients

When conducting periodic verification of employees or contractors.

From public sources

Such as social networks or online search engines, where legally permitted.

From authorized sources

Including government authorities, courts, public records, educational institutions or employers.

We may also collect information when monitoring the use of our website, including through cookies and similar technologies such as web beacons.

Purpose of Processing

The Personal Data and/or Sensitive Personal Data that data subjects provide through the sources specified in the section “How do we collect your personal data” are used for the following purposes:

  • confirm identity
  • validate background information
  • verify employment references
  • verify academic records
  • consult public or private registries.

The above, as well as the subsequent processing of the information, will be carried out during the retention period established in accordance with applicable legislation.

Marketing Use

We do not use personally identifiable information for marketing or advertising purposes unless we have your explicit consent, for example, when you fill out a form or use our chat for that purpose.

When data is used for statistical purposes, it will be anonymized beforehand.

Categories of Personal Data We Process

Depending on the service, we may process:

  • identification data
  • contact data
  • employment data
  • academic data
  • immigration data
  • address information
  • financial data
  • health data (sensitive).

In the cases indicated with respect to financial and health information, your express and/or written consent will be requested, as appropriate.

This Privacy Policy is available to you, and by providing us with your personal data or sensitive personal data, you agree to its processing as set forth herein. If you do not agree, you may express your refusal by following the mechanisms described in this document.

In addition, we may collect and process data on behalf of and in representation of our clients in sectors such as finance, industry, technology, professional services, manufacturing, energy, transportation, and the public sector, among others.

Processing of Sensitive Personal Data

In order to provide our verification services, First Advantage may process sensitive personal data only when strictly necessary to comply with legal or regulatory obligations applicable to the requesting client or to verify the suitability of the data subject for a specific position in accordance with current legislation.

Sensitive data that may be processed includes, but is not limited to: information relating to health status, criminal records where permitted by law, and any other data whose nature requires a heightened level of protection in accordance with the LFPDPPP.

First Advantage undertakes to process such data under enhanced security measures, applying criteria of proportionality, minimization, and necessity, and exclusively for the purposes described in this Privacy Notice. Under no circumstances will sensitive data be used for discriminatory purposes or for purposes other than those stated herein.

The processing of sensitive personal data will require the express consent of the data subject, which will be collected in writing, electronically, or through equivalent authentication mechanisms prior to processing.

Transfer of Personal Data

First Advantage may transfer your personal data only when necessary to carry out the requested verifications, when there is a legal requirement, or when instructed to do so by a competent authority.

In such situations, we will take the necessary measures to ensure that those who receive the information maintain its confidentiality, protect it adequately, and use it only for authorized purposes.

Disclosure of Personal Data

We do not disclose your personal information to third parties outside of the cases provided for in this Privacy Policy, except when permitted by law or authorized by you.

In all cases, the third party receiving the information must comply, by law or contract, with security and confidentiality obligations. Likewise, they may only use the data for the purposes described in this Policy.

Data Retention

We will only retain your personal data for as long as necessary to fulfill the purposes of the service and in accordance with the requirements established by our client, who acts as the Data Controller.

Additionally, there may be legal provisions or requirements from authorities that oblige us to retain the information for a specific period.

When there is no defined period, we will delete personal data within a maximum of two years after the verification process has been completed.

Means for exercising the rights of personal data subjects

You may request to exercise your ARCO rights at any time, which include:

  • Accessing your personal data;
  • Rectifying it when it is inaccurate or incomplete;
  • Canceling it;
  • Opposing its processing for legitimate reasons;
  • Revoking your consent.

To exercise any of these rights, you must send a request to First Advantage at Privacy.Latam@fadv.com

The request must contain, at a minimum:

  • Your full name and a means of contact to communicate the response to you;
  • documents proving your identity or, where applicable, legal representation;
  • a clear and precise description of the data for which you wish to exercise a right;
  • in the case of rectification, the requested modifications and supporting documentation;
  • any other element that facilitates the location of the information.

It is important to note that in some cases we will not be able to comply with your request or suspend use immediately, for example, when there is a legal obligation that requires us to continue processing the data.

Similarly, revoking consent for certain purposes may mean that it is not possible to continue with the applicable legal relationship.

First Advantage will respond to your request within a maximum of 20 business days, in accordance with current Mexican regulations. The exercise of these rights will also be carried out in accordance with the applicable laws and regulations in the country.

Means to limit the scope (use or disclosure) of your personal data

You or your duly accredited legal representative may, at any time, object to the processing of your personal data for purposes that are not essential to the legal relationship that gave rise to the processing.
